Essentials 305 — Terms & Conditions

These Terms and Conditions (“Terms”) govern access to and use of the essentials305.com website and the purchase of any products from Essentials 305 (“Essentials 305,” “we,” “our,” or “us”).

By accessing this website, creating an account, or purchasing any product from Essentials 305, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use this website or purchase products from us.

We reserve the right to modify these Terms at any time. Updated Terms become effective upon posting. Continued use of the website or purchase of products after changes are posted constitutes acceptance of the revised Terms.

1. Acceptance of Terms

By accessing this website, creating an account, placing an order, or purchasing any product from Essentials 305, you agree to be bound by these Terms. If you do not agree, you may not use this website or purchase products from us.

2. Nature of Products Sold

Essentials 305 sells two distinct categories of product. It is the buyer’s responsibility to read the specific listing for each item to determine which category applies before purchasing.

2.1 Certified / Traceable Parts (Third-Party Sourced)

Certain products offered on this site are sourced from third-party suppliers and may include used, overhauled, repaired, or new-surplus aircraft parts carrying FAA-PMA approval, TSO approval, and/or traceability documentation (including FAA Form 8130-3 where applicable).

These parts are sold subject only to the condition description, traceability documentation, and certification status specifically stated on the individual product listing at the time of sale.
Unless a specific certification, tag, or traceability document is explicitly stated and included with the listing, the part should not be assumed to carry that certification.
Essentials 305 is a reseller of these parts and is not the original manufacturer, PMA holder, or repair station responsible for the certification unless explicitly stated otherwise.
Photos are representative of the actual item unless otherwise stated. Cosmetic condition does not imply airworthiness.

Checkout Acknowledgment: Any order containing one or more certified/traceable parts from this category requires the buyer to affirmatively check a box at checkout acknowledging that: “I understand that this is a used, overhauled, or new-surplus part, and that I am solely responsible for verifying fitment, compatibility, and airworthiness eligibility of this part for my specific aircraft, make, model, and serial number prior to purchase and prior to installation. I understand that Essentials 305 is a reseller of this part and is not the certifying authority, original manufacturer, or repair station.” This acknowledgment is recorded with the order and constitutes the buyer’s express acceptance of these terms as applied to that specific purchase.

2.2 Non-Certified Aftermarket Parts (Essentials 305 Manufactured)

Certain products offered on this site are designed and manufactured by Essentials 305, including 3D-printed interior accessories and components.

These products are not FAA-certified and are not PMA or TSO-approved parts.
These products are intended for use in experimental, homebuilt, amateur-built, or non-certificated aircraft, or for static display on non-airworthy/grounded aircraft, museum exhibits, and non-flying replicas only.
These products are not approved for installation in any aircraft that holds or may hold a current airworthiness certificate.
Any part numbers referenced in connection with these products are provided as cross-reference for mounting-geometry purposes only and do not represent the product as an approved or certified replacement part.

Checkout Acknowledgment: Any order containing one or more non-certified Essentials 305 manufactured parts requires the buyer to affirmatively check a box at checkout acknowledging the FAA Notice set out in this Section 2.2 before the order can be completed. This acknowledgment is recorded with the order and constitutes the buyer’s express acceptance of these terms as applied to that specific purchase.

If an order contains items from both categories, the checkout will present both applicable acknowledgments, and both must be affirmatively checked before the order can be completed.

3. Product Condition and Descriptions

Essentials 305 makes commercially reasonable efforts to ensure listings are accurate. However:

Listings may contain errors, omissions, or typographical mistakes.
In the event of an obvious pricing, shipping, or listing error, Essentials 305 reserves the right to cancel the order prior to shipment and issue a full refund.
Essentials 305 cannot guarantee that all item descriptions, photographs, compatibility references, or specifications are entirely accurate, complete, or current, and assumes no responsibility for such errors beyond correcting the listing and, where applicable, canceling and refunding the affected order.

4. Compatibility and Fitment

Buyers are solely responsible for verifying that any part — certified or non-certified — is appropriate for their specific aircraft, make, model, and serial number prior to purchase and prior to installation.

Part numbers, cross-references, and aircraft model lists provided on this site are for reference purposes only.
Essentials 305 recommends verifying fitment against your aircraft’s Illustrated Parts Catalog (IPC) or with a qualified mechanic prior to ordering.
Essentials 305 does not guarantee fitment and is not responsible for parts ordered in error by the buyer.

5. Warranties

5.1 Certified / Third-Party Sourced Parts

ESSENTIALS 305 IS A DISTRIBUTOR/RESELLER OF THESE PARTS. PRODUCTS SOLD UNDER THIS CATEGORY ARE NOT MANUFACTURED BY ESSENTIALS 305. SUCH PARTS MAY BE COVERED BY A WARRANTY ISSUED BY THE ORIGINAL MANUFACTURER, OVERHAUL FACILITY, OR REPAIR STATION, WHERE APPLICABLE. ANY SUCH WARRANTY IS PROVIDED SOLELY BY THE ISSUING PARTY AND CUSTOMER’S RECOURSE, IF ANY, IS AGAINST THAT ISSUING PARTY ONLY. EXCEPT AS EXPRESSLY STATED ON THE INDIVIDUAL LISTING, ESSENTIALS 305 MAKES NO INDEPENDENT WARRANTY, EXPRESS OR IMPLIED, AS TO ANY SUCH PART, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH PARTS ARE SOLD “AS-IS” EXCEPT FOR THE SPECIFIC CONDITION AND TRACEABILITY REPRESENTATIONS STATED ON THE LISTING.

5.2 Non-Certified Essentials 305 Manufactured Parts

Where stated on the individual listing, Essentials 305 provides a limited replacement warranty (e.g., 1-year replacement guarantee) covering manufacturing defects only. This warranty does not cover installation labor, removal labor, damage occurring after delivery, or misuse.

6. Returns Policy

6.1 Non-Certified Essentials 305 Manufactured Parts

Essentials 305 offers a 30-day return window from date of delivery. Items must be unused and in original condition. See our full [Refund and Returns Policy] for details.

6.2 Certified / Third-Party Sourced Parts

Due to the nature of certified and traceable parts, returns require a Return Merchandise Authorization (RMA) prior to shipping the item back. Contact us to request an RMA before returning any certified part.

Returns must be requested within 30 days of the invoice date to be eligible for a full refund, subject to inspection.
Returns requested outside of the 30-day window, or accepted at our discretion after that window, may be subject to a restocking fee of up to the full purchase price.
Items must not be installed, altered, disassembled, or modified to be eligible for return.
Original shipping charges are non-refundable unless the return is due to our error.

7. Airworthiness and Installation Responsibility

The installing mechanic, repair station, aircraft owner, and/or operator are solely responsible for determining:

Airworthiness
Regulatory compliance
Compatibility with the specific aircraft
Proper installation
Inspection and continued operational suitability
Safe operation

Essentials 305 does not provide installation services, maintenance services, engineering approvals, or airworthiness determinations. Any information provided by Essentials 305 — including verbal statements, emails, website descriptions, or technical discussions — is informational only and does not constitute engineering advice, maintenance instruction, or regulatory approval.

Owners of type-certificated aircraft may have limited options to install certain parts as “owner-produced parts” under 14 CFR § 21.9(a)(5); however, this determination and the associated responsibility rest solely with the aircraft owner/operator, not Essentials 305.

8. Limitation of Liability

To the fullest extent permitted by law, Essentials 305 shall not be liable for:

Installation errors or improper maintenance
Regulatory non-compliance
Improper storage or handling after sale
Aircraft operation or pilot judgment/decision-making
Subsequent modification or alteration of any part
Acts or omissions of third parties (including third-party manufacturers, overhaul facilities, or repair stations)

Essentials 305 shall not be liable for any indirect, incidental, special, consequential, punitive, or third-party damages, including but not limited to loss of use, loss of revenue, aircraft damage, personal injury, or death.

If liability is established, Essentials 305’s total liability shall be strictly limited to the purchase price paid for the specific part at issue.

9. Indemnification

The buyer agrees to indemnify, defend, and hold harmless Essentials 305, its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Improper installation or misuse of the product
Failure to determine airworthiness or regulatory compliance
Unauthorized modification or alteration
Operation of an aircraft incorporating the part
Personal injury, death, or property damage resulting from the buyer’s actions or omissions

This indemnification obligation survives the sale of the product.

10. Shipping, Export, and Risk of Loss

Risk of loss transfers to the buyer upon delivery to the carrier. Shipping timelines are estimates only and are not guaranteed.

Buyers are responsible for providing accurate shipping information, and for compliance with all applicable customs, import, and export regulations. Certain products may be subject to U.S. export control laws (administered by the U.S. Department of Commerce, Department of State, and Department of the Treasury). Essentials 305 reserves the right to refuse any transaction that may violate applicable export laws or sanctions programs. Export control laws are complex; nothing on this site constitutes legal advice regarding export compliance.

11. Payment Terms

Orders must be paid in full prior to shipment unless credit terms are approved in writing. Essentials 305 reserves the right to cancel unpaid orders, refuse future transactions, or require alternate payment methods for certain orders.

12. No Professional Advice

Information provided by Essentials 305 — including verbal statements, emails, website descriptions, or technical discussions — is informational only. It does not constitute engineering advice, maintenance instruction, legal advice, or regulatory approval. For technical or compatibility questions beyond what is stated on the listing, consult a qualified A&P mechanic or the original part manufacturer.

13. Intellectual Property

All website content, including images, descriptions, branding, and media, is the property of Essentials 305 (or its respective licensors) and may not be copied or reproduced without written permission.

All aircraft manufacturer names, model names, and trademarks referenced on this site are used for identification purposes only and remain the property of their respective owners. Essentials 305 is not affiliated with or endorsed by any aircraft manufacturer.

14. Right to Refuse Service

Essentials 305 reserves the right to refuse service, cancel orders, limit quantities, or decline transactions at its sole discretion, including in cases of suspected fraud, pricing errors, export compliance concerns, or abusive conduct.

15. Website Use

You agree to use essentials305.com only for lawful purposes and in accordance with these Terms. You agree not to access or attempt to access the website through any automated means, including scripts or web crawlers, and not to duplicate, reproduce, copy, sell, trade, or resell the website or any part of it for any purpose. You are solely responsible for any breach of this section and for any resulting loss or damage to Essentials 305.

16. Force Majeure

Essentials 305 shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, labor disputes, supply chain disruptions, carrier delays, government actions, export restrictions, or cybersecurity incidents. In such events, our obligations shall be suspended for the duration of the condition.

17. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to the purchase of products from Essentials 305 or these Terms shall be resolved by binding arbitration administered by a nationally recognized arbitration organization, conducted by a single arbitrator in Miami-Dade County, Florida, or a venue of our choosing. The parties waive the right to a trial by jury. Any dispute shall be brought solely in an individual capacity and not as part of a class, consolidated, or representative action; class actions and class arbitrations are expressly waived. Nothing in this section prevents Essentials 305 from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property or enforce payment obligations.

18. Governing Law and Venue

These Terms shall be governed by the laws of the State of Florida. Subject to Section 17 above, any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

19. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.

20. Waiver and Entire Agreement

The failure of Essentials 305 to enforce any provision of these Terms shall not be deemed a waiver of that provision. These Terms, together with the applicable order confirmation/invoice, constitute the entire agreement between the buyer and Essentials 305 regarding the subject products, superseding all prior or contemporaneous communications.
